Changes to Queensland Tenancy Laws Introduced by the RTA in May

In May, the RTA implemented updates to the tenancy laws in Queensland.

As Property Managers, it is essential for us to grasp these changes and integrate them into our procedures. Although this can be a hectic period, if we take the time to break it down, it is manageable within our existing processes.

Here’s a concise overview of the changes:

  • Standardized Application Form: A new standard application form for general tenancy is now available on the RTA website. We may continue using online platforms, provided they align with the new regulations.
  • Submission Options: Applicants must now have two different methods to submit their applications, ensuring that at least one is unrestricted – not through an online platform or in a way that costs money
  • Specific Detail Requests: The questions on the standardised application form are the only questions a property manager/owner is allowed to ask the tenant during the application stage
  • Identity Verification: An applicant can verify their identity by presenting original documents or providing a copy. Property managers or owners must not retain a copy of the original documents unless the applicant has consented. No consent is necessary if a copy is provided instead.
  • Usage of Information: The information collected must be used exclusively to evaluate the applicant’s suitability as a tenant.
  • Secure Storage: An applicant’s personal information must be securely stored and used solely for the application process.
  • Record Keeping: Applicants should keep a copy of their application form for their own records.
  • Alternative Documentation: If an applicant lacks the requested documentation, they should consult with the property manager or owner regarding suitable alternatives.

In some respects, we were already adhering to these guidelines, while in other areas, we worked diligently to ensure compliance with the new legislation. It was a busy time, but we managed to navigate it successfully.
